ITEM SUMMARY

To approve the terms and conditions of a Fourth Amendment to Route Specific Communications Facilities License by and between the City of Plano, Texas, a home rule municipal corporation, and Cogent Fiber LLC (fka Sprint Communications Company L.P.), a Delaware limited liability company; authorizing its execution by the City Manager; and providing an effective date. Approved

PREVIOUS ACTION/PRESENTATION

A Third Amendment to Route Specific Communications Facilities License amending the term and cost of the License and replacement of Exhibit A was approved at the February 22, 2021, City Council meeting. 

BACKGROUND

The City and the Licensee entered into a Route Specific Communications License dated February 5, 2001; a First Amendment to the License dated January 19, 2006, which amended certain terms of the License; a Letter Agreement dated November 23, 2010, which extended the License to February 4, 2016; a Second Amendment to the License dated September 16, 2015; and a Third Amendment to the License dated February 26, 2021.

 

The City and Licensee desire to further amend the License in this Fourth Amendment to reflect the Licensee's name change from Sprint Communications Company L.P. to Cogent Fiber LLC, modify the cost of the License, and extend the term of the License for an additional five (5) years.

FINANCIAL SUMMARY/STRATEGIC GOALS

Approval of this item would renew a License granted to Cogent Fiber fka Sprint that permits the installation, operation, and maintenance of Cogent communications equipment at City of Plano facilities for a five-year term. Cogent will choose to either pay a lump sum for the entire five-year term in the amount of $137,441, or an annual payment each year of the five-year term, with the first payment being $27,488, and each subsequent annual payment increasing by three percent (3%). The license allows for a five-year renewal if the City of Plano and Cogent both agree.

 

Obtaining revenue by granting a License to telecommunications providers to install, operate, and maintain equipment at City of Plano facilities relates to the City's Strategic Plan Critical Success Factor of Excellent, Innovative, and Accountable City Government.
