ITEM SUMMARY

Second Reading and adoption of Ordinance No. 2020-1-12 to grant to Oncor Electric Delivery Company LLC, its successors and assigns, an electric power Franchise to use the present and future streets, alleys, highways, public utility easements, and public ways and other public property of Plano, Texas, providing for compensation therefor, providing for publication, providing for written acceptance of this Franchise, providing for the repeal of all existing Franchise Ordinances to Oncor Electric Delivery Company LLC, its predecessors and assigns, finding that the meeting at which this Ordinance is passed is open to the public, providing a severability clause, providing a savings clause, and providing for an effective date and a term of said Franchise. (First Reading was held on December 9, 2019.) Read and adopted

First Reading was held at the December 9, 2019 City Council meeting. 

BACKGROUND

Oncor Electric Delivery serves around 92% of the City's electricity infrastructure. The terms of this franchise agreement will extend through November 30, 2040. 

FINANCIAL SUMMARY/STRATEGIC GOALS

The extension of this Franchise Agreement will produce an indeterminable amount of revenue in the General Fund, attributable to a quarterly franchise fee based on each kilowatt hour of electricity delivered by Oncor to each retail customer whose consuming facility’s point of delivery is located within the City’s municipal boundaries, as well as, the annual franchise fee based on 4% of the gross revenues received by Oncor identified as "Discretionary Service Charges", as defined in the agreement. As a point of reference, anticipated Oncor Electric Franchise Fee Revenue to be received in FY 2019-20 is approximately $11.2 million.  

 

Approval of this Ordinance will support the City's Strategic Plan Critical Success Factor of being an Excellent, Innovative, and Accountable City Government.
