| | | | | | | | ITEM SUMMARY Ordinance No. 2020-4-4:To repeal Division 5, Graffiti, of Article II, Signs, of Chapter 11, Licenses and Business Regulations and amend Article I, In General, of Chapter 14, Offenses - Miscellaneous, of the Code of Ordinances of the City of Plano by adding Section 14-15, to provide for procedures and notice for graffiti removal that conform to State law; to create an offense for failure to remove graffiti; and providing a penalty clause, a severability clause, a repealer clause, a savings clause, a publication clause, and an effective date. | | | | | | | | BACKGROUND Graffiti violations have historically been regulated through Code of Ordinance Chapter 11 and enforced by the Neighborhood Services Department. The ordinance was last amended in 2009 due to the Texas Legislature requiring municipalities to offer no cost graffiti removal to the property owner prior to issuing a Notice of Violation. The current ordinance contains noticing requirements that are not consistent with the State. Abatement procedures are not well organized and create confusion with staff and citizens, resulting in delayed graffiti removal.
The Neighborhood Services Department has met with both the former and current Chief of Police and there were no objections to these ordinance amendments. The Police Department only utilize the Texas Penal Code when filing graffiti cases and do not reference the city ordinance. This amendment will allow clear interpretation of notice and abatement processes for staff and citizens, resulting in more effective enforcement and compliance actions. |
