ITEM SUMMARY

Resolution No. 2021-7-8(R):  To approve Dallas Area Rapid Transit (“DART”) Resolution No. 210036 for the acquisition of Parcel CB3-013 at 910 10th Street in the City of Plano, Texas for the purpose of construction, improvement, and operation of DART’s Silver Line Regional Rail Project and other public improvements and projects related hereto; and providing an effective date. (Tabled at April 26, 2021, City Council meeting.) Adopted

PREVIOUS ACTION/PRESENTATION

The Plano City Council tabled a resolution at its April 26, 2021 meeting which would have approved DART Resolution 210036 for both CB3-013 at 910 10th Street and CB3-014 at 901 10th Street.  

BACKGROUND

DART is preparing to construct the Silver Line project and has identified properties necessary to construct and operate the line in the near future.  The subject property at 910 10th Street is among those identified as necessary for the segment of the line between the City of Richardson and the future 12th Street Station in Plano.   At its March 23rd meeting, the DART Board approved the acquisition of this property and authorized the use of eminent domain proceedings if DART could not acquire the parcel in accordance within DART's Real Estate Policy framework. If DART obtains Plano's approval, it is conclusive evidence of the public necessity of the acquisition and the public use of the property.  This approval was sought at the Plano City Council's April 26th meeting, at which time the City Council elected to table approval of DART's resolution and directed that negotiations should occur before it considers granting approval for DART's use of eminent domain in the future.

DART extended an offer to the owner of the property following the April 26th meeting and has been negotiating in good faith.  At this point, the DART property acquisition team believes they have reached an impasse in negotiations and requests the City Council  approve eminent domain authority for the acquisition of this parcel.

FINANCIAL SUMMARY/STRATEGIC GOALS

This item has no financial impact.

 

Approval of this acquisition by DART relates to the City's Strategic Plan Critical Success Factors of Residential and Commercial Economic Vitality and Multi-Modal Transportation and Mobility Solutions.
