To approve a request to withdraw from consideration a resolution regarding DART Resolution No. 210036 to allow the use of eminent domain for acquisition of real property at 901 10^th Street known as Parcel CB3-014 for the DART Silver Line Regional Rail Project. Approved

After the City Council's consideration and tabling of the resolution regarding the acquisition of CB3-014 at 901 10^th Street on July 26, 2021, DART and the property owner have continued communication and have not yet reached an impasse in their acquisition discussions necessitating eminent domain.  Given the complexities surrounding the acquisition negotiations and uncertain timeline to negotiate all matters fully, DART has submitted a letter withdrawing their request for the Plano City Council to approve the resolution regarding the acquisition and use of eminent domain for the subject property.  Should an impasse occur, DART will resubmit its request at a future date.
