Resolution No. 2022-1-3(R):To amend Resolution No. 2020-4-1(R) and ratify the appointment of James M. McCarthy as contract Senior Associate Municipal Judge of the Municipal Court of Record of the City of Plano, and providing an effective date. Adopted

Judge McCarthy was appointed as a full-time Senior Associate Judge for a term of office of four (4) years beginning July 1, 2020. Judge McCarthy retired from his employment with the City of Plano effective September 3, 2021.

Contract Senior Associate Municipal Judge Cathy Haden has submitted her resignation from her judgeship in Plano effective December 31, 2021. Judge Haden serves the City by being available after business hours to review and issue search warrants to draw blood samples from persons arrested on suspicion of Driving While Intoxicated. Judge McCarthy has volunteered to assume the duties that Judge Haden has been performing.

The contract Senior Associate Municipal Judge will be an independent contractor and will be paid on an hourly basis for legal services rendered  in the same manner and at the same rates as the other Associate Judges.

This item will ratify the appointment of James M. McCarthy as the contract Senior Associate Municipal Judge of the Municipal Court of Record. Judge James M. McCarthy will serve the remainder of the four-year term of office approved by Resolution No. 2020-4-1(R) ending on June 30, 2024 and expenditures will occur within Council approved appropriations.

Approval of this Resolution will support the City's Strategic Plan Critical Success Factor of Excellent, Innovative, and Accountable City Government.
