ITEM SUMMARY

Ordinance No. 2022-8-2: To abandon all right, title and interest of the City, in and to that certain right of way recorded in Volume F, Page 433, of the Collin County Map Records and being situated in the Joseph Klepper Survey, Abstract No. 213, which is located within the City limits of Plano, Collin County, Texas; quitclaiming all right, title and interest of the City in such right of way to the property owner, Clyde P. Hanawalt & Gladys Hanawalt, Trustees of the Hanawalt Living Trust dated July 28, 1999 and any amendments thereto, to the extent of its interest; authorizing the City Manager or his authorized designee, to execute any documents deemed necessary; and providing an effective date. Adopted

BACKGROUND

The owners of 1218 J Avenue submitted a request to abandon an 8 square foot segment of alley right-of-way known as J Place to rectify an 8 inch encroachment of their building into the existing right-of-way. This encroachment was identified during the inspection period of a pending real estate transaction of the property.  City staff has examined the encroachment and determined a certificate of occupancy cannot be issued until the encroachment is resolved.

 

The City owns a fee interest in the alley right-of-way, which has a valuation of $255 determined by Collin Central Appraisal District’s appraised value for the 1218 J Avenue property. The purchaser of the property has agreed to pay this amount for the property and the costs of recording all documents for the proposed abandonment.

 

The Engineering Department has reviewed this request and determined that there are no detrimental effects to the City if the Right-of-Way is abandoned and quitclaimed to the Hanawalt Living Trust.  Staff recommends approval of the request to abandon the segment of J Place alley as requested.

FINANCIAL SUMMARY/STRATEGIC GOALS

The abandonment of the identified portion of alleyway will result in a one-time revenue in the estimated amount of $255 to the Street Improvements CIP.

 

Approval of this item will support the City's Strategic Plan Critical Success Factor of being an Excellent, Innovative, and Accountable City Government.
