RECOMMENDED ACTION:Items for Individual Consideration

ITEM SUMMARY

Public Hearing and consideration of an Ordinance to accept and approve the Annual Update of the Service and Assessment Plan and Assessment Roll for the Downtown Plano Public Improvement District; levying Assessments against property within the District and establishing a lien on such property; providing for the method of assessment and the payment of the Assessments in accordance with Chapter 372, Texas Local Government Code, as amended; providing penalties and interest on delinquent Assessments; providing for severability; resolving matters incident and related thereto; and providing an effective date. PREVIOUS ACTION/PRESENTATION

On February 27, 2023, the City Council of the City (the City Council) held a public hearing in the manner required by law and adopted the Ordinance in conformity with the requirements of the PID Act by a majority of the members of the the City Council the Downtown Public Improvement District. 

 

On July 27, 2023, the Downtown Public Improvement District Advisory Board approved the final Service and Assessment Plan. 

BACKGROUND

The Service and Assessment Plan (SAP) outlines services and improvements to be performed by the District and will include, but not limited to, payment of expenses related to: (1) the promotion of the district (marketing, advertising, special event production, etc.); (2) enhancement of security in the district; (3) constructing and maintaining place-making elements (public art, street furniture, landscaping, streetscape, etc.); and (4) establishing, administering and operating the District as authorized by the Act.

 

This action is being undertaken now to establish a new schedule in sync with Collin County Appraisal District, who will now be responsible for collecting the levies beginning in 2024.  This will remove the collection burden from the City and further Council goals of transparency  regarding informing buyers that the property is within a public improvement district and subject to additional levies.

 

Staff recommends that Council conduct the public hearing and approve the attached ordinance adopting the final Service and Assessment Plan for the Downtown Public Improvement District.  

FINANCIAL SUMMARY/STRATEGIC GOALS

The City will not be obligated to provide any funds to finance the Authorized Services, other than from assessments levied on the Property. No municipal property in the District shall be assessed.

 

Approval of this Ordinance supports the City's Strategic Plan Critical Success Factors of Residential and Commercial Economic Vitality and Excellent, Innovative, and Accountable City Government.
