To approve a decrease to the current awarded contract amount of $4,465,480 by $106,708, for a total contract amount of $4,358,772, for 10th Street Paving and Water Line Reconstruction - N Avenue to Jupiter Road, Project No. 7343, from McMahon Contracting and Construction, LLC dba McMahon Contracting, L.P. for the Engineering Department; and authorizing the City Manager to execute all necessary documents.  (Contract No. 2023-0103-B; Change Order No. 2) Approved

On February 27, 2023, City Council awarded RFB No. 2023-0103-B for 10th Street Paving and Water Line Reconstruction - N Avenue to Jupiter Road, Project No. 7343 to McMahon Contracting and Construction, LLC dba McMahon Contracting, L.P. in the amount of $4,432,023.

The Engineering Department recommends approval of Change Order No. 2 for the decrease in the construction contract with McMahon Contracting and Construction, LLC dba McMahon Contracting, L.P., in the amount of $106,708 for the 10th Street Paving and Water Line Reconstruction - N Avenue to Jupiter Road.

Change Order No. 2 primarily addresses the reconciliation of item quantity increases and items not necessary in the original scope resulting from field adjustments made by City staff, as well as the inclusion of new line items necessary to meet and reconcile field conditions. 

Change Order No. 1 was executed on December 29, 2023 and increased the amount by $33,457 for a total contract amount of $4,465,480.

If this change order is not approved, the project would remain incomplete, resulting in continued deterioration of the existing pavement along 10th Street, increased maintenance costs in the future and reduction of the quality of service to the businesses located on this street and the adjacent streets.

This item approves the second change order in the contract with McMahon Contracting and Construction, LLC dba McMahon Contracting, L.P. for construction services for the 10^th Street Paving and Water Line Reconstruction - N Avenue to Jupiter Road, Project No. 7343.  The second change order reduces the current contract by an estimated $106,708 for project closeout.
